Terms used in the regulations mean:
1.1 Application - Application for the Android or iOS operating system
1.2 Service - a service providing a server necessary to use the Application
1.3 Subscription Payer - a natural person, a legal person or an organisational unit that is not a legal person, the legal regulations of which provide for legal capacity, paying for subscription
1.4 End User - natural person, legal person or organisational unit that is not a legal person, the specific provisions of which grant legal capacity, using the Application
1.5 Service Provider - providing the service / Mateusz Truszczyński
1.6 Subscription - payment for using the license of the application and servers of the Service Provider
1.7 The "Entrepreneurs’ Law" Act - the Act of March 6, 2018, coming into force on April 30, 2018 (unified text, Journal of Laws of 2018, item 646)
2. GENERAL PROVISIONS
2.1. The promptli.com service is run by Mateusz Truszczyński (NIP: 9570988579) residing in Kartuska 345A/4 80-125 Gdańsk, Poland under the Act "Entrepreneurs' Law", Chapter 1, Art 5, because the income due from this activity does not exceed 50% of the minimum wage. 2.2. In order to use the Service and Applications, it is necessary to be 18 years of age
2.3. The service is provided in accordance with the price list published on the website promptli.pl/promptli.com
2.4. The presented products and services do not constitute an offer within the meaning of art. 66 of the Civil Code.
2.5. The Service Provider reserves the right to change prices and Services
2.6. These regulations enter into force on the day of its publication on the Service Provider's website - March 11, 2019.
2.7. Regulations can be found at www.promptli.com and are available to anyone at any time.
2.8. The paying subscriber pays the subscription according to the price list on the promptli.com website or according to the rate agreed in writing by the Service Provider and the Subscription Payer. This rate does not include technical support costs
2.9. Technical support (including implementation of the Service and installation of the Application) is additionally payable in accordance with the rate agreed in writing by the Service Provider and the Subscription Payer
2.10. It is not possible to use the Application nor Device without paying a subscription
3. COMPLAINT CONDITIONS
3.1. The User has the right to make a complaint and in order to submit a complaint correctly, the User must submit a complaint by sending an e-mail to email@example.com
3.2. If the Service is unavailable for more than 24 hours, the subscription for the license is extended by the time of unavailability
3.3. The Service Provider is responsible for the Service up to the amount of the Subscription paid
4.1. The administrator of personal data is Mateusz Truszczyński residing in Gdańsk (NIP: 9570988579), firstname.lastname@example.org
4.2. Data protection is carried out in accordance with the requirements of generally applicable laws, in particular the Regulation of the European Parliament and the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (GDPR) and the repeal of Directive 95/46 / EC.
4.3. The User has the right to file a complaint to the President of the Office for the Protection of Personal Data in Poland.
4.4. Processors of personal data under the entrustment agreements are:
a. Google Cloud - The service is provided on Google Cloud servers (us-central1) located in the United States in Iowa State under the privacy shield and standard clauses
b. Google GSuite - for purposes of e-mail, data may be located outside of the EEA under the privacy shield and standard clauses
4.5. Data transfer is secured by SSL protocol
4.6. Personal data necessary to provide the Service are collected, such as: data necessary to issue an invoice and Users' data: email address. The Service may contain other personal data placed there by the Users and the Subscribtion Payer.
4.7. Personal data shall be deleted within 36 months from the end of using the Service at the latest
4.8. The data administrator has the right to disclose personal data to third parties if it is required by law (eg law enforcement authorities)
4.9. User's rights:
a. the right to access your data, including obtaining a copy of the data
b. the right to demand the rectification of the data the right to delete the data (in certain situations)
c. the right to lodge a complaint to the President of the Office for the Protection of Personal Data.
d. the right to limit data processing
e. the right to object.
4.10. Withdrawal of consent to the processing of personal data during the inquiry for Help results in resignation from the Subscription without refund of the amount paid for this Subscription
